Petroleum Sites
Is Your Petroleum Site Eligible for a Loan?
 
A brownfield that’s contaminated only by petroleum—not a mix of petroleum and other contaminants—is considered a petroleum-only site. These sites are usually closed or abandoned gas stations and storage facilities. They’re contaminated by a petroleum product from an above or underground storage tank (UST) or other means. To qualify for a cleanup loan as a petroleum-only site, your site must meet the following criteria:
  • The site is of relatively low risk compared to other petroleum-only sites in the state
  • The site is not being cleaned up using Federal Leaking Underground Storage Tank (LUST) trust fund money
  • The site is not subject to a response under the Oil Pollution Act (OPA)
  • There is no viable responsible party financially capable of the cleanup. You are not eligible for a [loan] if you caused or contributed to the contamination
  • The site is not subject to a corrective action order under Section §9003(h) of the Solid Waste Disposal Act (42 USC 6991b (6))
